SEAN M. WALSH

Mr. Walsh focuses his practice on a variety of commercial and employment litigation matters and also defends broker-dealers, corporations and their officers and directors accused of violating securities laws in federal, state and administrative forums, including the Securities Exchange Commission and the National Association of Securities Dealers.

Experience:

• Successfully secured summary judgment in favor of a large, international manufacturer of safety and restraint systems for the automotive industry in a breach of contract and intellectual property dispute with hundreds of millions of dollars at stake.

• Successfully defended a motion to dismiss a class action RICO complaint filed on behalf of a group of physicians against Blue Cross Blue Shield of Michigan for its failure to timely pay the physicians' claims. The U.S. District Court adopted plaintiffs' argument that Blue Cross is not an insurance company and that its provider contracts with the plaintiff- physicians do not implicate the business of insurance, and therefore, the plaintiffs' RICO claim was not barred by the McCarran-Ferguson Act.

• Successfully prosecuted a motion to dismiss in favor of two former officers of K-Mart in a class action securities fraud case filed by a class of K-Mart's former shareholders against several of the company's former directors and officers following K-Mart's bankruptcy filing.

• Secured summary disposition of a multi-million dollar action filed against Comerica Bank where the plaintiff, an accounts receivable factoring company, alleged that the bank improperly converted the proceeds of an electronic payment order.
